Details About the Liquid Blenz Recall

The potential for Botulism was discovered during an analysis by the Cornell Food Venture Center and field-testing done by New York State Department of Agriculture and Markets Food Inspectors. Although there have been no reported illnesses to date, the company has issued a recall out of an abundance of caution.

The recalled liquid supplement was sold nationwide via retailers and online. It was packaged in amber colored bottles with plastic caps, available in both 16 oz and 32 oz bottles. The UPC code for the 16 oz bottle is 860010984468, and the 32 oz bottle’s UPC code is 860010984475.

What Is Botulism?

Botulism is a rare, but extremely serious and sometimes fatal, illness caused by a nerve toxin produced by bacteria known as Clostridium botulinum. This toxin acts by attacking the body’s nerves, which can lead to muscle paralysis, difficulty breathing, and, in some cases, death, when not immediately treated.

This infection is considered a medical emergency. It is often linked to improper canning, contaminated food, and wound infections. Botulism can also be contracted through overdose of certain cosmetic/medical injections, such as Botox, although contracting it this way is considered rare. Botulism is not contagious, meaning it does not spread from person to person.

Symptoms of Botulism

Early signs of botulism include double vision, blurred vision, slurred speech, dry mouth, droopy eyelids, sluggish pupils, and difficulty swallowing. Gastrointestinal issues such as nausea, vomiting, abdominal cramps, and constipation may also appear. Weakness typically descends through the body, leading to possible respiratory failure and paralysis if left untreated. Symptoms of botulism typically appear 18–36 hours after exposure, though they have been known to appear 6 hours to 10 days later.

Symptoms in infants are similar, however they have a slight variation, including constipation (typically the first sign), a weak cry, poor muscle tone (floppy baby), drooping eyelids and lack of facial expression, poor feeding, lethargy, and loss of head control.

Holding Negligent Manufacturers Responsible

If you suffered illness from contaminated food, you can hold the manufacturer responsible with the help of a product liability attorney. A product liability attorney can help you in a number of ways, including:

  • Gathering evidence
  • Investigating the cause of your illness and linking it back to the manufacturer
  • Handling the necessary documentation
  • Representing you in court, should negotiations fail to land a reasonable settlement offer

A product liability attorney is a valuable ally during your case, and having an attorney on your side increases your chances of a fair and full settlement.

What Damages Can You Claim in a Product Liability Lawsuit?

In a product liability lawsuit, you can claim economic and non-economic damages to cover medical expenses, lost wages, lost earning capacity, pain and suffering, and emotional distress. In the event the defective product caused you to lose your loved one, you can claim wrongful death damages as well.

Although rare, punitive damages may be awarded if the court finds the negligent party’s actions to be particularly egregious.

Product Liability FAQs

What Makes a Product Defective?

A product is considered defective if it is considered unsafe to use or consume, even when used properly. This can be due to a design flaw, manufacturing error, or marketing defect. Defective products can often cause harm to unsuspecting consumers.

Who Can Be Held Liable?

It depends on the specifics of your case, but typically, manufacturers, distributors, and even retailers can be held responsible for damaged and defective products that lead to personal injury.

How Long Do I Have to File a Claim?

In Florida, you typically have around 2 years to file a product liability claim, however, the sooner you file, the better, as evidence can disappear over time, making it harder to link your harm to the defective product in question.
