Clearwater, FL (April 24th, 2025) Consumers in Florida are urged not to eat Harvest NYC Inc.’s Enoki mushrooms after testing found possible listeria contamination. If consumed, the contaminated mushrooms may cause serious illness or, in some cases, death.

What Florida Residents Need to Know About the Listeria Enoki Mushroom Recall

According to the U.S. Food and Drug Administration (FDA), Harvest NYC Inc. issued a recall for it’s 200g packages of Enoki mushrooms on April 16, 2025. The product recall was issued due to potential contamination with Listeria monocytogenes, a bacterium that can cause serious, or even fatal, infections.

The affected products were distributed nationwide, including throughout Florida, by Hofood99 Inc. While no illnesses have been reported yet, the threat is serious, especially for vulnerable groups like pregnant women, newborns, older adults, or those with compromised immune systems. 

Why Does This Recall Matter for Florida Consumers?

Florida’s mix of permanent residents, retirees, and tourists makes food safety a critical issue, especially when it comes to bacteria like Listeria monocytogenes. Many Floridians shop at national retailers or ethnic grocery stores that carry products like Enoki mushrooms. As such, the risk of exposure may be greater than many think.

Short-Term Effects of Listeria Infection

In healthy adults, a Listeria infection, also known as listeriosis, can resemble a bad bout of food poisoning. Symptoms usually begin within a few days to a few weeks of exposure, and may include:

  • Fever
  • Muscle aches
  • Nausea or vomiting
  • Diarrhea
  • Fatigue

These, and other symptoms caused by Listeria infections, can be especially dangerous for seniors, pregnant women, and people with weakened immune systems – populations that make up a significant percentage of Florida residents.

Long-Term Health Risks and Complications

While some people recover without issue, others may experience more serious health problems. In severe cases, Listeria can spread beyond the gut, entering the bloodstream or central nervous system. Long-term complications associated with listeriosis may include:

  • Septicemia, a potentially life-threatening blood infection
  • Meningitis, an inflammation of the membranes surrounding the brain and spinal cord 
  • Permanent brain damage or cognitive impairments
  • Pregnancy complications, such as miscarriage, stillbirth, or neonatal infection

Listeriosis outcomes such as these often require hospitalization and long-term medical care. In rare cases, Listeria infections may lead to death, especially in elderly or immunocompromised patients.

Suing for Food Poisoning in Florida

Florida’s product liability laws allow consumers to file claims when dangerous or defective products cause them harm. They may pursue such legal actions under theories, including strict product liability, negligence, or breach of warranty. 

Cases such as these often involve product testing, medical records, and expert opinions. Documentation, including receipts, packaging, and photos, can help support strong claims.

Who Is Legally Responsible for Selling Contaminated Food in Florida?

Under Florida personal injury law, multiple parties could be liable for selling or distributing a contaminated food. For instance, this includes the manufacturers for producing a contaminated product, the distributors for passing on ap product they knew, or should have known, was dangerous, or retailers for failing to remove recalled products from shelves in a timely manner. What to Do if You Purchased the Recalled Mushrooms

If you live in Florida and recently bought Enoki mushrooms, especially from January 11 to January 31, 2025, there’s a chance the product may be part of the recall. Consumers with Enoki mushrooms at home should:

Check the Packaging

You should check the packaging right away if you’ve recently purchased Enoki mushrooms to ensure yours are not included in the dangerous and defective product recall. 

If you already used the mushrooms, keep any remaining packaging or receipts. Should you need to file a refund request or take legal action later, such documentation can be helpful.

Don’t Eat the Mushrooms

Do not rinse, cook, or try to salvage any part of the product. Listeria monocytogenes can survive refrigeration and low levels of cooking. Even if there are no visible signs of contamination, eating the product poses a serious health risk.

You may have already eaten the contaminated mushrooms. If so, don’t panic. You should, however, monitor yourself for symptoms.

Dispose of the Product and Sanitize Storage Area

To prevent cross contamination in your kitchen or garbage, you should seal the affected mushrooms in a plastic bag and place them in a covered trash bin. Preferably, you can dispose of the mushrooms in an outdoors bin. However, you should avoid placing loose mushrooms directly into your garbage disposal or compost pile.

Once disposed of, you will need to clean and disinfect the areas where the mushrooms were stored. To this end, you should wipe down shelves and bins with a bleach-based cleaner or disinfectant spray. Make sure you use gloves or wash your hands frequently during the cleaning process.

Report Illness or Suspected Contamination

If you believe the product made you sick or caused harm to someone in your household, you should report it to the appropriate agencies. You may contact the local Florida Department of Health office, file a complaint with the Florida Department of Agriculture and Consumer Services, or submit a food safety report to the FDA’s MedWatch Portal.

Such reports can help trace outbreaks and assist with future enforcement or legal claims.

Request a Refund

Most retailers will honor product recalls by offering a full refund. Return the product with the original packaging or a receipt if available. If you no longer have proof of purchase, call the store where you bought the mushrooms and ask about their refund policy for recalled goods.
